PEMBATASAN PERKARA KONTRA HAK UNTUK BANDING

Terjadi pertentangan antara kepastian hukum dan pemenuhan hak dalam suatu pembatasan perkara yang dapat dimintakan banding. Dalam pembahasan mengenai pembatasan perkara selalu muncul kritikan-kritikan dan penolakan. Tulisan ini mencoba untuk mencari jawaban atas perdebatan mengenai pembatasan perkara dari segi historikal, gramatikal dan prosedural. Dilanjutkan dengan pembahasan mengenai upaya-upaya, baik dari negara maupun dari masyarakat untuk mendorong pembatasan perkara demi tercapainya fungsi kasasi sebagai penjaga kesatuan hukum.
