PROBLEMATIKA PERIKANAN PADA ZONA EKONOMI EKSKLUSIF INGGRIS DAN UNI EROPA

Penelitian ini menjelaskan peristiwa Brexit yang memunculkan problematika perikanan antara Inggris dan Uni Eropa (UE) yang berupa persoalan pilihan metodologi dan mekanisme pengalokasian kuota perikanan. Penelitian hukum normatif ini menggunakan pendekatan
perundang-undangan, kasus, dan perbandingan. Hasilnya, persoalan yang menjadi perbedaan atas pemanfaatan sumber daya perikanan antara Inggris dan Uni Eropa terletak pada metodologi penentuan jumlah kuota tangkapan ikan melalui instrumen hukum yang dibentuk oleh para pihak. Uni Eropa ingin menggunakan basis persentase alokasi yang bersifat tetap (relative stability), sedangkan Inggris ingin menggunakan basis tangkapan spesies yang terikat pada zona (zonal attachment). Bentuk solusi diantaranya dapat berupa kombinasi antara mekanisme ‘zonal attachment’ (keterikatan spesies berdasarkan zona), ‘historical attachment’ (keterikatan wilayah penangkapan berdasarkan sejarah), ‘relative stability’ (stabilitas relatif berbasis persentase alokasi tetap), maupun pendekatan lain (Hannesson Model).
