Abstract
This paper aims to analyze the provision governing a government agency responsible for manpower affairs shall continue to issue a decree regarding the registration of a Collective Labor Agreement if the parties continue to agree on the content of the Agreement contrary to the applicable laws and regulations. To obtain this objective, this legal research uses legislative approach and systematic interpretation. Based on the discussion, it can be concluded that the provision is stipulated due to the consideration that the Collective Labor Agreement is a form of written agreement arising from private relation between trade unions and employers on the basis of contractual freedom.

Abstrak
Tulisan ini bertujuan untuk menganalisis ketentuan bahwa instansi terkait ketenagakerjaan harus tetap menerbitkan surat keputusan pendaftaran jika para pihak tetap bersepakat atas materi Perjanjian Kerja Bersama yang bertentangan dengan peraturan perundang-undangan yang berlaku. Untuk memperoleh tujuan tersebut, penelitian hukum ini menggunakan pendekatan perundang-undangan dan penafsiran sistematis. Berdasarkan hasil pembahasan, maka dapat disimpulkan bahwa ketentuan mengenai instansi terkait ketenagakerjaan harus tetap menerbitkan surat keputusan pendaftaran jika para pihak tetap bersepakat atas materi Perjanjian Kerja Bersama walaupun bertentangan dengan peraturan perundang-undangan yang berlaku adalah didasarkan atas pertimbangan bahwa Perjanjian Kerja Bersama merupakan suatu bentuk perjanjian tertulis yang lahir dari hubungan privat antara para pekerja yang diwakili oleh serikat pekerja dengan pengusaha atas dasar kebebasan berkontrak.
