Abstract
Immigration or refugee was matter that always been exist in human civilization. Since the motive to get better life, free from fear and treat. To response the problems international community through United Nations released Convention 1951 regarding to Status of Refugee. Other hand, Indonesia as transit state provide legal instrument as legal instruction for related institutions in handling illegal immigrant/refugee problems. This article described about Immigration Office at Malang on Handling of Illegal Immigrant/refugee based on Indonesia’s regulation compare to Convention 1951 regarding to status of refugee.

Abstrak
Pengungsi merupakan suatu persoalan yang akan selalu ada dalam perkembangan peradaban manusia, karena persoalan pengungsi berlatar belakang naluriah manusia untuk mencari kehidupan yang lebih baik, baik dari aspek ekonomi, politik, keamanan dsb. Indonesia sebagai Negara yang terletak pada posisi silang dunia menjadi tempat strategis untuk transit para pengungsi, terutama para pengungsi/imigran gelap. Di satu pihak dalam konteks internasional telah ada suatu standart dalam memperlakukan pengungsi melalui Konvensi 1951 tentang Status Pengungsi. Artikel ini akan membahas mengenai peran dari Kantor Imigrasi kelas I Malang dalam penanganan imigran gelap/pengungsi dikaitkan dengan Konvensi 1951 tentang status pengungsi.
