EKSISTENSI ASAS KEBEBASAN BERKONTRAK DALAM PERJANJIAN KERJA

Artikel ini mengkaji eksistensi asas kebebasan berkontrak dalam pembuatan perjanjian kerja. Perjanjiankerja akan melahirkan adanya hubungan kerja antara pengusaha dan pekerja. Pada asasnya, pengusahadan pekerja mempunyai kebebasan berkontrak dalam menentukan kondisi dan syarat-syarat kerja dalamperjanjian kerja. Namun, kebebasan tersebut telah sangat dibatasi oleh campur tangannya negara dalambentuk Peraturan Perundang-undangan yang bermaksud melindungi pekerja sebagai akibat kedudukanpekerja yang lemah dibanding pengusaha. Juga dalam prakteknya, dapat dikatakan kebebasan berkontraksudah tidak lagi dimiliki oleh pekerja akibat kuatnya daya tawar pengusaha dan kuatnya kebutuhanpekerja untuk memperoleh pekerjaan.
